Al-Baqarah 240: Those who die and leave behind widows should leave a testament that their wives can benefit from their wealth for up to one year without being driven out of the house. Tafsir
Islam is a religion that gives life to people. He says to make a will to the widow whose husband has died and left her a widow while she is still alive, giving her the right to live in her own house for up to one year.
A woman was not entitled to her husband's inheritance when he died, but she was entitled to his inheritance if she had lived in their home for a year.
Allah (swt) guides people with His verses so that women can get their share of the inheritance to which they are entitled. What does the verse say? The dying husband should make a will for his wives to stay in his house for one year. If she renounces her inheritance before that and leaves because of legitimate things she has done for herself, that is, if she marries, there is no sin on anyone.
Some commentators say that this verse has been abrogated by the verse about women's inheritance, which we will come to later. There is no prohibition between verses. Every Ayah of Allah (swt) is obligatory upon us in everything that we are required to do. Therefore, if Allah gives her the right to inheritance by staying in his house for a year, then we will explain in the verses to come, where we will see that there is no uniqueness between the two in terms of the woman's right to inheritance, nor is there any kalām that contradicts one or the other. The fact that the verse that says that a woman can renounce her deceased husband's inheritance when she marries another man, and that this verse says the same thing, shows that there are no contradictory words between these verses. If we pay close attention to these verses, we will not make Allah (swt) speak in vain. Every verse of Allah (swt) has a wisdom.
We have said before that Allah is the pinnacle of the art of speech, and the reason why He speaks softly to people is that He makes them do a job by making them get used to it, and because the Creator knows His creatures, He removes the difficulties from them and makes them like the jobs they are going to do. Otherwise, He has not changed any of His Verses with any other verse, nor has He contradicted any of His Verses with any other verse. Such words are attributes of Allah. Allah does not fit into the human mind. Because man's intellect has been given to him in a limited form. The universal mind is Allah. You cannot fit the universal into the particular. Therefore, if we say that this or that has been abrogated, we are sinning, there is a wisdom in each of the Verses sent by Allah. Believing in verses that we cannot comprehend by saying that there is a wisdom in this too that Allah (swt) has intended and pointed out, shows our respect for Allah (swt) and our obedience to Him. If women leave their deceased husbands' houses legitimately, there is no sin on anyone. But throwing women out when they have nowhere to go, scheming to deny them a share of the inheritance, and behaving in a way that leads women to evil ways is sinful.
Allah (swt), who has addressed the minds of people, has informed them of the actions that they will do, down to the finest details, and has left them free in what they will do. In this respect, man will be rewarded for what he does voluntarily within the legitimate deeds that Allah has revealed, and he will be sinned in the sight of Allah for what he does voluntarily outside the path that Allah has shown him. On the Day of Judgment, every human being will be held accountable before Allah (swt) in the Court-i Kübra for the good deeds and good deeds they have done.
Allah is the saint and the judge. He is the Most High and is aware of all the affairs of His servants. All the worlds are under His sovereignty.
What is said in the video
Verse 240 of Surah Al-Baqarah is where we come to now. Those of you who die and leave widows behind, without their wives being put out of their homes, regarding their benefiting for a year from the property they leave, should make a bequest while in good health, it says. Now, a person may have two or three marriages.
He may have wives. Allah Almighty has made this lawful for them, that is. Or a man's wife has died. He has married again. Then this time the man dies, and the wife is in the house. His other children immediately tell her: come on, off you go from here. That is not acceptable.
See, Allah Almighty protects people. Why not, Hodja? What right does that woman have to that property? If you say that: even if that woman has no right to that property, that woman served your father. How will you repay the right your father has over you?
But that woman earned a right by serving your father. So even if you give her nothing of that property, at least let her benefit from that property for one year. Let her live in her home. Let the children look after that mother. She is their mother. If need be, let them never put her out at all. As a keepsake of their father. Ah, unless the woman leaves of her own accord. That is an exception. How beautiful our religion is. And how beautifully Allah Almighty protects every side. How beautifully it speaks to consciences. It speaks to humanity. Yes. If those women leave of their own accord, see, of their own accord, if they leave, then for the lawful things they do regarding themselves there is no sin on you. Allah is Mighty, Wise.
What more could you want? Yes. In the verse.
Allah Almighty has granted life to everyone. (?) in Islam.
We have said that Islam is a religion that gives people life. For the husband who dies leaving a widow, it says that while alive, before dying, he should grant them, for up to a year, the right to live in their own homes, by making a bequest; that is the command. To whom? To his children. To whom? To whoever is more responsible: father, mother, whoever. When their husband died, women could not become entitled to their husband's inheritance. Only when they lived in their homes for about a year did they become entitled to their husband's inheritance. After living there about a year. Allah Almighty puts all of this into order, just like this.
So that women can take their share of the inheritance that is their right, Allah Almighty guides people with His verses. What does it say? In the verse: the husband who is about to die should make a bequest for his wives left behind to stay in his home for a year. See, those to whom the father left an inheritance, in return for the right that the one who left the inheritance left them, must show respect to the wives who served him. Yes. Before this, if the woman gives up the inheritance and, for lawful things she has done regarding herself, leaves, that is, if she marries, there is no sin on anyone.
The woman says: my husband has passed away, I don't want to stay here, so goodbye, she says, (?). But even if she has a father, a mother, even if the woman has somewhere to go, out of respect for her husband she wants to benefit from there. That is, rather than going to her mother's and father's house, eating from her husband's property pleases her more. Without making her mother and father spend on her needs. Yes. Look, consider these things.
The human heart is like glass. It breaks very easily. And Allah Almighty says: seek Me in sorrowful hearts. In sorrowful hearts. Yes.
So comfort the hearts of those sorrowful people. Help them. Helping them is like helping Allah Himself. Yes, had Allah wished, He could have granted him a (?) over you too. But we are always tested by one another. So if He is in those sorrowful hearts, Allah's manifestation is there; your drawing near to that person is your drawing near to Allah.
In this verse, some commentators say that, through the verses we will come to later about women having a share of the inheritance, it was abrogated. We always say: there is no abrogation.
Allah's attributes (?) abrogation. Because people cannot understand it, they say it was abrogated (?).
In this respect, what does the book in our hands say? Let's see. Well, in verse 240, what does the book in our hands say?
According to the narrations, near Wasit, in Daverdan, a contagious disease broke out. The townspeople fled from there. No, not this verse. This is the explanation of another verse. Nothing is written here. It has not taken a narration here. Yes.
No commentary on this has been made in a book. That is the interpretation the commentators make. As for between the verses, we say there is no abrogation. Every verse of Allah Almighty that requires us to do something is obligatory in every matter. The verses. Accordingly, if Allah, to someone, that is, to the wife whose husband has died, left a widow in her home, through the woman staying in the home for a year, a right to the inheritance is granted, we will also explain the verses to come. There we will see that between that and the woman receiving her share of the inheritance there is no (?) or any words contradicting each other, we say.
In the next verse too, by saying that the woman, when she marries another man, can give up her late husband's inheritance, and this verse saying the same things, it becomes clear that among these verses there are no words contradicting each other, we say. If we pay close attention to the verses, we will not make Allah Almighty speak in vain. Every verse of Allah Almighty has a wisdom. We said it before too: Allah is the summit of the art of speech, and it is for speaking softly to people, getting people used to a thing step by step and having them do it, and, since the Creator knows His creatures, for removing the difficulties on them and making people love the things they will do.
Otherwise, none of His verses has He replaced with another verse, none of His verses with another verse has He contradicted; know this for certain. Such words (?) to Allah, that is, that was abrogated by this, this was abrogated by that; if that were so, if this were a human (?), there would be in it words that (?) each other, it says. That was abrogated, that was abrogated: since these (?) would have fallen into not agreeing with each other, the verses would contradict one another. Allah's (?). Allah does not fit into people's minds. Of course, I cannot (?) Allah with my mind. Or if I did (?) Allah with my mind, I would become (?) to His art of creation.
Because the human mind is given to him as a partial one. The universal mind is Allah. You cannot fit the (?) inside the partial. How beautiful, here we are trying to explain. So if we say that, or something, was abrogated, we fall into sin. That is, what are we saying: that's why, if we say this or that was abrogated, we fall into sin. In each of the verses Allah has sent there is a separate wisdom. Toward verses our minds cannot grasp, saying: surely in this too there are wisdoms that Allah Almighty intends and points to, and so believing in the verses shows our respect for Allah Almighty and that we are obedient to Him.
Now, as I said a moment ago, the woman's husband has died, and the heirs left behind, his father, mother, brother, his other sons, whoever, tell the woman: come on, leave the house. What did we say? This is not becoming.
Perhaps, if the wife of the man who died were your sister, and the children there told your sister: come on, leave the house, what would you do? Should she not claim any right at all? First this: you will put yourself in her place and decide accordingly. Our forefathers say it so well: stick the needle into yourself first, and the packing needle into others. If you can bear your needle, (?) the packing needle too.
That's why we will be just. That man left this property to those entitled to inherit, to those people. But this woman also served that man. Where did her right go?
Her right: so that the people give from that right to them, look after her for at least a year, it says. One year. After a year, Allah guarantees the provision of what He has created. He will give her provision anyway. Once she has stayed there a year, she is entitled to his property anyway. He was her husband, after all. Something falls to her too. As the right of marriage. The right of marriage.
If women leave their late husbands' homes in a lawful way, there is of course no sin on anyone. It's done and gone. There is no sin. She gave it up, she said: I don't want it. It's done and gone. But throwing women out when they have nowhere to go, scheming in every way so as not to give them a share of the inheritance,
and acting in a way that drives women onto a bad path is a sin.
Even if the man is alive, if he has divorced his wife and the woman has nowhere to go, it says: kindly, for a certain period, that is, until she can fend for herself, until Allah shows her a good way, keep her kindly in your home, it says. How beautifully it says it. Allah Almighty does not want anyone to be hurt. Allah Almighty, who speaks to people's minds, the deeds people will do He has made known to them down to the finest detail, and has left them free in what they themselves will do. How beautiful. What are we saying? Look, let's read it again.
Allah Almighty, who speaks to people's minds, the deeds people will do He has made known to them down to the finest detail, and has left them free in what they themselves will do. What does this mean? Allah Almighty made a covenant with people in the address Elestü bi-Rabbiküm. He wrote their desires, aims and wishes for them as destiny. And when He sent them to the (?), Allah Almighty, so that they would not say: You sent us to the (?); had You only sent us proofs to make known Your Essence and Your ways, showed them their ways down to the finest detail. Then, by leaving them free in their will, He made them witnesses over themselves.
For this reason, a person, within the lawful things Allah has made known, earns reward for the things he does by his own will.
Likewise, within his own will, in everything he does outside the way Allah Almighty has shown,
he incurs sin before Allah. On the Day of Resurrection every person, for the good and fine deeds he did, at the Supreme Court is called to account in the presence of Allah Almighty.
Allah is Mighty and Wise. He is most exalted. And He is aware of all the affairs of His servants. All the worlds are under His rule. That is, when it says Allah is Aziz and Hakim: He is most exalted. And aware of all the affairs of His servants; all the worlds are under His rule. Yes.
